In an action to recover damages for breach of contract, plaintiff moved on the ground of excusable default to vacate court orders that dismissed the complaint for plaintiff’s failure to appear at the call of the trial calendar.
Manhattan Supreme Court Justice John J. Kelley granted the motion, vacated the orders, and reinstated the complaint.
