The Law Journal’s front page article by Emily Saul on the American Bar Association’s Task Force Report on Plea Bargaining discloses what concerned observers—such as the Brennan Center and the Innocence Project—have long known. 

It’s no secret that the overwhelming number of criminal cases dispositions (the report says 98%) are obtained by the defendant’s agreement to plead guilty to a lesser crime. This inevitably means innocent people are jailed.
