Bringing suit under 42 USC §1983, Kayson Pearson claimed his rights under the Eighth and Fourteenth Amendments were violated because, while in custody of New York’s prison agency (DOCCS), he was subjected to 13 years of solitary confinement without appropriate periodic reviews.

In addition to claiming that Pearson did not allege facts plausibly showing their personal involvement in the alleged constitutional violations, defendant DOCCS officials sought dismissal of Pearson’s First Amended Complaint contending that his claims as to events prior to Sept. 25, 2017, were time-barred under the appropriate three-year statute of limitations. The court denied defendants dismissal.
