Baker & Hostetler filed a trademark this month in New York Southern District Court on behalf of Hermès International and Hermès of Paris Inc. against Mason Rothschild. The suit accuses Rothschild of violating the trademark for the iconic Hermès Birkin bag in his creation and sale of MetaBirkin non-fungible tokens, or NFTs, that have made over $1 million in sales. Counsel have not yet appeared for the defendant. The case is 1:22-cv-00384, Hermès International et al v. Rothschild.
