A New York City police detective and his outspoken anti-vaccination lawyer said they will seek, as early as Tuesday, a federal court order aimed at helping them ultimately compel Mayor Bill de Blasio to temporarily halt his administration’s COVID-19 vaccination requirement for all city employees.

The detective and his attorney said they will base their attempt to win the order on a bench ruling they achieved in the detective’s state Supreme Court lawsuit. In that ongoing action against city officials, brought pursuant to New York’s CPLR Article 78 statute, Det. Anthony Marciano contends that the city’s vaccine mandate violates his constitutional and civil rights.
