U.S. District Judge Gary Brown of the Eastern District of New York has turned back an effort from a group of small landlords to block New York’s revised COVID-19 eviction moratorium, finding that they lack standing because they have not tried to seek relief under the procedures laid out by the state.

The moratorium law was revised by state legislators in September after the U.S. Supreme Court struck down a key portion of the original statute when it considered the suit now before Brown, which is captioned Chrysafis v. Marks.
