The U.S. Court of Appeals for the Second Circuit on Friday reinstated a jury’s conviction of a now-defunct hedge fund executive and for defrauding investors in a Texas-based oil-and-gas firm, in a major victory for Brooklyn federal prosecutors who successfully tried the case in 2019.

The ruling, from a three-judge panel of the Manhattan-based appeals court, overturned a federal judge’s decision granting post-trial acquittal to David Levy, the former co-chief investment officer of Platinum Partners L.P.
