Manhattan Supreme Court Justice Barry Ostrager has ruled in favor of Kasowitz Benson Torres client CW Capital Management when he denied a motion to dismiss filed by broker Tribeca Realty Capital.

CW, represented by Kasowitz partner Paul O’Connor and special counsel Frank DiCarlo, sued Tribeca and the real estate development firm Hongkun USA Real Estate Development in March, arguing that Hongkun breached an agreement under which CW would provide up to $205 million in senior loan financing for the development of condominiums in Weehawken, New Jersey.
