U.S. District Judge Eric Komitee of the Eastern District of New York on Friday denied the Roman Catholic Diocese of Brooklyn’s request to open its churches in state-designated COVID-19 “red zones” for attendance by more than 10 people at Sunday mass, making him the second federal judge to uphold the executive order issued by Gov. Andrew Cuomo.

Komitee agreed with an argument advanced by Randy Mastro of Gibson Dunn & Crutcher, who is representing the diocese, that the order was aimed at combating outbreaks among Orthodox Jewish communities, but he nevertheless denied the diocese’s request for a temporary restraining order.
