An Italian restaurant in Queens is suing Gov. Andrew Cuomo over the state’s ban on indoor dining in New York City.

The litigation filed Aug. 28 in state court comes from the Queens eatery Il Bacco, which is located near Nassau County, where indoor dining is permitted. The lawsuit says New York City is the only region of the state where restaurants are not allowed to host customers for indoor dining, even though recent coronavirus figures are similar or lower compared with other areas of the state.
