The issue of standing has plagued plaintiffs in recent data-breach cases, but a federal appeals court has ruled in their favor by reversing the dismissal of a class action against P.F. Chang’s China Bistro Inc.

The U.S. Court of Appeals for the Seventh Circuit, citing its own 2015 decision in a data-breach case against Neiman Marcus Group Ltd. LLC, found that the named plaintiffs had asserted plausible injuries in order to establish standing to sue P.F. Chang’s. Thursday’s ruling was a big win for plaintiffs, which have struggled to overcome standing hurdles in cases over recent data breaches.
