The U.S. Supreme Court on Wednesday rejected a lower court ruling requiring Title VII plaintiffs to show that a discriminatory job transfer resulted in “significant” harm, reviving a lawsuit from a police officer claiming she was moved out of a prestigious task force because she is a woman.

In Muldrow v. City of St. Louis, the Supreme Court unanimously vacated a U.S. Court of Appeals for the Eighth Circuit ruling that a Title VII claim over a discriminatory job transfer must result in “materially significant disadvantages” for the employee. Still, the Supreme Court required Title VII plaintiffs to show at least some harm to bring a discrimination lawsuit, a holding that could temper challenges to workplace DEI policies.
