The U.S. Senate on Tuesday confirmed labor attorney Nicole Berner to the U.S. Court of Appeals for the Fourth Circuit on a 50-47 vote.
Berner is President Joe Biden’s third appointee to the Richmond, Virginia-based court and will fill the seat left vacant when Judge Diana Gribbon Motz took senior status in September.
