The U.S. Supreme Court on Friday denied an anti-affirmative action group’s request for an emergency injunction that could have prevented West Point admissions officials from considering race for candidates for the class of 2028.

The justices denial allows Students for Fair Admissions to proceed with its challenge to the military academy’s policy while it remains in place. In issuing their denial, the justices stated that “the record before this Court is underdeveloped, and this order should not be construed as expressing any view on the merits of the constitutional question.”
