The U.S. Court of Appeals for the Ninth Circuit on Monday reiterated its long-standing precedent that embedding social media posts doesn’t violate copyright laws, but internet law experts are still closely watching any emerging challenges to the circuit’s widely adopted “server test.”

Judges Jay Bybee, Patrick Bumatay and U.S. District Judge Richard Bennett, sitting by designation, rejected a lawsuit from two photographers who sued Instagram, alleging that the company violated their exclusive display right by allowing third-party sites such as BuzzFeed and Time to embed copyrighted pictures they posted to their Instagram sites.
