The U.S. Supreme Court has agreed to reconsider the conviction of Joseph Percoco in an appeal that will examine whether non-government individuals with official connections can be convicted of honest-services fraud.

Percoco, an ex-top aide to former Gov. Andrew Cuomo, was convicted in 2018 of accepting $300,000 to use his government connections to benefit two companies. His appeal centers on a count arising from his involvement with Syracuse-based developer COR Development. According to prosecutors, the company paid Percoco $35,000 to persuade a state official into allowing COR to receive state funding for a development project.
