A Minneapolis police officer who shot two dogs during a residential security check was not granted qualified immunity by the U.S. Court of Appeals for the Eighth Circuit on Monday.

Judges Lavenski Smith, Bobby Shepherd and L. Steven Grasz upheld a lower court’s decision that officer Michael Mays was not entitled to immunity from a lawsuit filed by two Minneapolis residents, who allege the officer violated the Fourth and 14th amendments when he shot their service dogs, Ciroc and Rocko, while performing a security check on their house.
