Tell us about your biggest trial win from January 2017 to July 2018 and how you achieved the result for your client.

We were lead counsel for Vanda Pharmaceuticals in a patent infringement lawsuit against West-Ward Pharmaceuticals Inc. (formerly Roxane Laboratories). West-Ward alleged that Vanda's patent on the use of anti-schizophrenia drug Fanapt was invalid because it covered a law of nature and therefore was not eligible for patenting. The case was important because the ability to patent a method of treatment like this is fundamental to Vanda's business model. We successfully showed how Vanda, by adjusting the dosage depending on a patient's individual genetic profile, overcame safety concerns that had led the drug's prior owner to abandon it. This win facilitates patents on personalized medicine inventions.

Share two trial tips that have been key to your success.
  1. The ability to do a good direct examination is really important—you have to prove that you deserve to win, not just demolish the other side on cross.
  2. Don't attack a witness on cross until the witness has made the factfinder think—or, more importantly, feel—that the witness deserves it.
