How much can happen in eight months? While case law concerning e-discovery and the new Federal Rules of Civil Procedure (FRCP) amendments continues to trickle out in both federal and state courts, the conversation surrounding the conceptions of proportionality (Rule 26) and consequences for failure to preserve (Rule 37) have been occurring in force.
“It’s exciting to see a lot more of this coming in; there’s been more discussion on proportionality in the past eight months than there has been in the past 30 years,” said Brian Corbin, vice president and assistant general counsel at JPMorgan Chase & Co.
