PMS Holdco, Wittman LLC and Tyler Wittman were hit with a breach-of-contract lawsuit on July 31 in Delaware Court of Chancery. The suit, brought by Troutman Pepper Hamilton Sanders on behalf of ARC NDT Acquisition, arises from a dispute over the terms of the defendants’ sale of Precision NDT, Pro Mechanical USA and Professional Mainland Safety to the plaintiffs, which allegedly resulted in a settlement last month. The complaint accuses the defendants of failing to execute a written settlement agreement or provide comments to the plaintiffs’ draft and seeks to compel execution. Counsel have not yet appeared for the defendants. The case is 2023-0777-, ARC NDT Acquisition LLC v. Wittman et al.
