Two Delaware pastors alleging state restrictions on congregation size during the pandemic violated civil rights laws have again had a case dismissed by a second state court, a decision their attorneys say they plan to appeal.

Superior Court Judge Meghan A. Adams issued an opinion Monday morning agreeing with Gov. John Carney and his Wilson Sonsini Goodrich & Rosati attorneys that since there’s nothing the court can do to address emergency restrictions ordered in the first several months of the pandemic but long since lifted, the two plaintiffs, represented by the Neuberger Firm, Jacobs & Crumplar, Cousins Law and Martin D. Haverly, don’t have standing to move forward with their case.
