Fox News has removed to Delaware federal court a new defamation case filed by a Jan. 6 protestor who says the network used him as a scapegoat after convincing him the 2020 presidential election had been stolen.

James Ray Epps Sr. claims despite his being a Donald Trump supporter, former host Tucker Carlson repeatedly stated on Fox News that Jan. 6 was orchestrated by the FBI and Epps was in on the plan to incite violence. Farnan LLP filed the case on Epps’ behalf Monday in Superior Court, joined by Teter Legal and Zimmerman Booher attorneys based in Utah, where Epps currently resides.
