Refusing to count mail-in ballots postmarked on time but received after Election Day would violate Delaware voters’ constitutional rights, the League of Women Voters of Delaware and a Lewes woman have argued in a Court of Chancery lawsuit.

The complaint asking for ballots postmarked on or before Nov. 3 to be counted if they’re received before Nov. 13 was filed last week by the American Civil Liberties Union of Delaware on behalf of the LWV and Rachel Grier-Reynolds against the Delaware Department of Elections and State Election Commissioner Anthony J. Albence.
