Eli Lilly, the Indianapolis-based pharmaceutical giant, filed a lawsuit on Sept. 19 in Georgia Southern District Court accusing a Georgia weight loss clinic of manufacturing and selling drugs masquerading as Lilly’s blockbuster diabetes drug Mounjaro. The suit, part of a string of cases backed by King & Spalding, alleges that Georgia Weight Loss & Aesthetics LLC is selling unapproved drugs purporting to contain tirzepatide, the active pharmaceutical ingredient in Mounjaro. Two other similar lawsuits were filed on the same day in Florida Middle District Court against two pharmacy businesses. According to the Georgia suit, Lilly is the only supplier of FDA-approved tirzepatide drugs in the U.S. Attorneys have not yet appeared for the defendant. The case is 5:23-cv-00087, Eli Lilly and Company v. Georgia Weight Loss & Aesthetics, LLC.
