New Suit - Trademark

Eli Lilly, the Indianapolis-based pharmaceutical giant, filed a lawsuit on Sept. 19 in Georgia Southern District Court accusing a Georgia weight loss clinic of manufacturing and selling drugs masquerading as Lilly's blockbuster diabetes drug Mounjaro. The suit, part of s string of cases backed by King & Spalding, alleges that Georgia Weight Loss & Aesthetics LLC is selling unapproved drugs purporting to contain tirzepatide, the active pharmaceutical ingredient in Mounjaro. According to the suit, Lilly is the only supplier of FDA-approved tirzepatide drugs in the U.S. Attorneys have not yet appeared for the defendant. The case is 5:23-cv-00087, Eli Lilly and Company v. Georgia Weight Loss & Aesthetics, LLC.
