In the wake of the recent U.S. Supreme Court arguments over the COVID-19 vaccine mandates, the court soon will take up a case that, while perhaps lacking the same national impact, nonetheless carries great significance for international litigation and, indeed, our federalist system.

Next week, in Cassirer v. Thyssen-Bornemisza Collection Foundation, the court will consider whether a federal court hearing state-law claims under the Foreign Sovereign Immunities Act (FSIA) should apply the federal common law or forum state conflicts principles.
