An appellate court in Florida was asked to decide whether a trial court or an arbitration panel should decide what caused damage to a home’s roof, which would determine whether the damage was covered by the homeowners’ insurance policy. The appellate court concluded that the answer depended on how the insurer had treated the rest of the homeowners’ claim.
