9701, Trademark Licensing, Protection and Use, the new policy lists specific unauthorized uses of these trademarks but also gives the Board the sole right to approve or reject, in any case, at any time, and at its discretion any and all licensing agreements, proposals, contracts and/or any
organization’s request. The policy also provides that Principals must properly account for revenues received from commercial licensing agreements and enforcement actions against unauthorized uses are detailed.

6320.04, Contractor Debarment Procedures, the Contractor Debarment Committee will be revised; renamed the Contractor Disciplinary Review Committee (CDRC), and its responsibilities and authority are specified and enhanced. The CDRC may also recommend other disciplinary
action or sanctions including revocation of a prequalification certificate or SBE/MWBE eligibility or suspend a contractor that violates
any Board policy. The amended policy provides that a contractor
disciplined under this policy may request a hearing in front of the
Division of Administrative Hearings (DOAH) to challenge a CDRC
recommendation. Final disciplinary determinations are made by the Board. Policy 6320.04 is proposed to be renamed from Contractor
Debarment Procedures to Contractor Discipline.

6334, Pre-qualification of Contractors for Educational Facilities Construction, to update office names and titles, cross-reference the Contractor Disciplinary Review Committee and clarify responsibilities of certain other committees and employees. In addition, the required 100% performance payment security bond on bids over $300,000 will lower to $200,000. The policy amendments also cross-reference Policy 6320.04 regarding disciplinary action.

9700.01, Advertising and Commercial Activities, to clarify procedures related to advertising in schools to be consistent with current practices and to specifically authorize the District to make advertising decisions related to non-school site venues, facilities and properties. The policy
also cross-references the new Policy 9701, Trademark Licensing,
Protection and Use, and makes other technical changes.

If requested a Hearing will be held during the March 9, 2016 School Board meeting. Persons requesting such a hearing must submit a
written request to the Superintendent of Schools, Room 912, same
address, by March 1, 2016. The policy will be effective upon filing with The School Board of Miami-Dade County, Florida on March 9, 2016. A person wishing to appeal any decision made by The School Board of Miami-Dade County, Florida, with respect to any action on this policy should ensure the preparation of a verbatim record of the proceedings,
including the testimony and evidence upon which the appeal is to be based. Copies of the policy and the notice of intended action are available to the public for inspection and copying at cost in the Citizen Information Center, Room 102, 1450 N.E. Second Avenue, Miami, Florida.
