Additionally, Policy 9215, Direct-Support Organizations is proposed to be amended to require DSOs to provide quarterly written reports of the following to the School Board: (1) any and all donations and/or pledges to donate to the DSO made by contractors, lobbyists, consultants, and bidders that exceed or will exceed $5,000.00 within a oneyear period, and for which there is a pending bid solicitation, proposal, or contract award for District goods or services; and (2) any and all District resources used during the reporting quarterly period in support of the DSO and its operations.

To Amend Board Policy 2510, Instructional Materials and Resources, and the accompanying procedures manual, to require that (1) all districtwide instructional materials must comply with the instructional materials review and adoption processes required under Florida law and Policy 2510 no matter how long the materials will be in use, and (2) that the Policy 2510 instructional materials review and adoption processes may be waived only if there is a statewide emergency declared by the Governor and the statutorily required processes are suspended. The waiver must be approved by the Board before the materials are used, and the waiver request must include the reasons for the waiver, the anticipated cost of the purchase of the materials, and a link to the proposed instructional materials. If the Board approves the waiver, the materials may be used immediately but the adoption and review process in Policy 2510 must be initiated at the next regular Board meeting. The procedures manual is also proposed to be revised to delete references to outdated programs and clarify the process for schools to request additional instructional materials.

To Amend Board Policy 5112, Entrance Requirements, to incorporate a technical correction to s. 1003.05, F.S. clarifying that a student whose parent is transferred or is pending transfer to a military installation within this state is considered a resident of the school district when the order is submitted to the school district and requiring such students to receive certain preferential treatment.

To Amend Board Policy 6233, District Budget, to align with s. 1011.62(6)(b)(3), F.S. by removing the reference to the Next Generation Sunshine State Standards to account for current and future changes in the standards and benchmarks adopted by the Florida Board of Education.

To Amend Board Policy 2410, School Health Services Program, to incorporate revisions to s. 1002.20(3)(l) and s.1002.33(9)(q), F.S., requiring that, prior to contacting law enforcement for an involuntary examination of a student under s. 394.463, F.S., school principals or their designees verify that de-escalation strategies have been utilized and outreach to an available mobile response team has been initiated unless the principal or the principal’s designee reasonably believes that any delay in removing the student will increase the likelihood of harm to the student or others. The proposed amendment also requires that parent notification be made within 24 hours unless the incident is treated as an abuse or neglect matter under s. 39.201, F.S.

To Amend Board Policy 9143, Secure Our Future Advisory Committee, to conform to s. 1011.71(9), F.S., requiring inclusion of charter schools in distribution of future funds generated by additional millage for school operational purposes.

To Amend Bylaws 0124, Standards of Ethical Conduct, 0141.2, Conflict of Interest, 0156, Legal Counsel, 0157, Inspector General, and Policies 1030, Superintendent of Schools, 1129, 3129, 4129, Conflict of Interest, and 6835, Office of Management and Compliance Audits, to add standards of ethical conduct and to incorporate a new Florida Commission on Ethics rule prohibiting public officers and public employees from abusing their public position to disproportionately benefit themselves, their spouse, their children, or certain other business interests they may be involved in. The proposed standards of conduct are generally based on the Principles of Professional Conduct for the Education Profession in Florida contained in state rule 6A-10.081, F.A.C., and are proposed to apply to the Board and all employees who directly report to the Board including the Superintendent, the Board Attorney, Chief Auditor, and Inspector General. In addition, the anti-nepotism provisions of F.S. 1012.23(2) are proposed to be added as well as other statutorily mandated reporting requirements. Additional revisions to Policy 0157, Inspector General, update the qualifications of the IG in accordance with Florida law.

To Amend Board Policy 5517.02, Discrimination/Harassment Complaint Procedures for Students, to reference the distinctive process to be applied for allegations of sexual harassment as opposed to discrimination and harassment based on other protected categories. They authorize the District’s Title IX Coordinator to coordinate the Board’s Title IX obligations. For clarity, the policy is proposed to be renamed Discrimination and Harassment Complaint Procedures for Students.

To Amend Board Policy 5517.03, Dating Violence or Abuse, to align it with the regulatory definition of dating violence; reference the specific process for complaints of sexual harassment (of which dating violence is a sub-set); align the record-keeping requirements; and revise language related to supportive measures for student victims. For clarity, the policy is proposed to be renamed Prohibition on Dating Violence and Abuse.

To Amend Board Policy 5610, Suspension and Expulsion of Students, to clarify that all decisions and appeals regarding disciplinary consequences for allegations of sexual harassment will be addressed through the Board’s sexual harassment grievance process.

To Amend Board Policy 2260, Nondiscrimination and Access to Equal Educational Opportunity, to align the confidentiality and record keeping requirements of the policy to the newly promulgated Title IX regulations.

The Title IX regulations prohibit disciplinary action against students, where a formal complaint of sexual harassment is made, until the completion of a grievance process set forth in the regulations. Additionally, policy amendments incorporated into the Code of Student Conduct-Elementary, the Code of Student Conduct-Secondary and the Code of Student Conduct-Post-Secondary, comport with the Florida Administrative Code Rule 6A-1.0017, School Environmental Safety Incident Reporting (SESIR) setting forth requirements school districts must use to report disruptive or criminal incidents to the Florida Department of Education.

To Amend Board Policy 0165, Public Meetings, to provide that any Board meeting scheduled to take place during a state of emergency declared by the governor, and when schools have been closed under Policy 8420, shall be cancelled. Both conditions must be present for a meeting to be automatically cancelled. The new language states that the Board Chair shall notify the Board and the Superintendent of the cancellation. In addition, a new section is added to allow the Board to meet virtually when the Governor declares a statewide emergency and suspends statutory quorum and location requirements for Board meetings.

Finally, additional policy amendments allow direct negotiations and contract under certain circumstances that do not involve collective bargaining.
