A woman who claimed she herniated two cervical discs and fractured a tooth when she tripped in front of a pharmacy recovered $25,825. Alice Bennett, then 74, fell in front of the Baptist Medical Arts Pharmacy in Miami. Bennett claimed that when she walked out of the store, she tripped over a nylon cord used to secure wheelchairs. The pharmacy denied that there was a nylon cord in the area where Bennett fell. It also claimed that it had no notice of any dangerous condition. Defense counsel claimed Bennett was comparatively negligent as she was walking with a cane, may not have been paying attention and lost her balance. The jury found Bennett 75 percent liable and the pharmacy 25 percent liable, reducing her $103,300 award accordingly.
