Plaintiffs’ lawyers defended their class action settlement over Johnson & Johnson’s recalled sunscreen but asked a federal appeals court to reverse denial of its incentive awards and, if necessary, take up the issue again.

Incentive awards are paid to lead plaintiffs in class action settlements, but, in 2020, the U.S. Court of Appeals for the Eleventh Circuit found them unconstitutional under two U.S. Supreme Court decisions from the 1880s.
