In a victory for small shareholders, the Third District Court of Appeal ruled Wednesday that a trial court erred in its award of more than $125,000 in investigative costs, based on dismissal of a derivative action not brought in bad faith.

The case stemmed from the Miami-Dade Circuit Court’s dismissal of Robert Cornfeld’s shareholder derivative action against Plaza of Americas Club, a not-for-profit corporation that owns and operates a condominium complex in Sunny Isles Beach.
