After a rare en banc hearing, the U.S. Court of Appeals for the Second Circuit sent a case challenging a transgender-inclusive high school athletic policy back to Connecticut federal court for further proceedings.
In 2021, a federal judge dismissed the lawsuit as moot, and the Second Circuit panel affirmed the decision in 2022. However, in June, the Second Circuit reheard the case en banc.
