The Connecticut Court of Appeals reversed a trial court judgment in favor of a Waterbury shopping mall, finding a security company did not have a duty to defend the plaintiff in an underlying wrongful death action.

The plaintiff, the owner of the Brass Mill Center & Commons shopping mall, and AlliedBarton Security Services had a security agreement, which set forth security services that the company was obligated to provide to the mall, such as reasonable inspection for hazards, appropriate response to emergencies and assignments related to the security and safety of the property, according to the appellate court’s opinion filed Tuesday.
