An animal-rights group litigating to remove three elephants from a Connecticut petting zoo and into a Tennessee sanctuary is gearing up to file an emergency motion, after one of the animals died Sunday.

Attorney Steven Wise, founder of the Florida-based nonprofit the Nonhuman Rights Project, said the group would ask the Connecticut Supreme Court to review the case as soon as possible. His group filed a habeas corpus petition on behalf of the elephants, arguing the animals are autonomous beings and have the right to bodily liberty. It has so far come out on the losing end after two dismissals amid questions about whether the group has legal standing to act on the elephants’ behalf.
