Following two hung juries, a federal class action lawsuit filed by Ocean State Job Lot assistant store managers is expected to be finalized for $1.9 million in July.

The class–which could reach 400 former and current employees who worked at six stores in the Northeast, including Connecticut and New York–was filed in 2009 claiming assistant stores managers were misclassified as exempt “executives” who did not receive overtime pay. An amended lawsuit filed in April claimed Ocean State required assistant store managers to work at least 48 hours a week during most weeks and 54 hours a week during “seasonal” times.
