SRA proposes easing restrictions on conflicts

New proposals from the Solicitors Regulation Authority (SRA) could lead to the relaxation of conflicts rules. Proposed amendments to the Solicitors' Code of Conduct 2007, released by the SRA last week (11 December), could see an increase in the number of circumstances in which law firms are permitted to act for sophisticated clients with conflicting interests. The suggested changes to rules three and four, covering conflicts of interest and duties of confidentiality and disclosure respectively, also see the SRA moving to increase the circumstances in which information barriers can be used.

Commentary: Death and taxes help private client teams beat the crunch

Speaking to your average M&A lawyer can be quite depressing these days. With no deals on the horizon this side of Christmas and banks not cutting any slack on financing, many partners are down in the doldrums. But not so for the private client lawyer. Tightening tax laws and falling oil prices mean more work for wealth management specialists. Despite a general downturn in activity in pretty much every sector bar litigation and restructuring, the private client arena has remained one of the more resilient to market fluctuations.Of course, much of this work, with the exception of the occasional high-profile divorce settlement, gets little press attention. And while the sector prides itself on client discretion, internally at least many partners are finding themselves in the limelight as one of the few remaining profitable practices in many firms.

Links set for £1m-plus weekly Lehman earnings

Linklaters' high-profile role on Lehman Brothers' administration is set to become one of most lucrative mandates in European legal history with the City giant now regularly billing more than £1m a week. The magic circle firm has confirmed that its role advising UK administrator PricewaterhouseCoopers (PwC) is currently engaging "several hundred" of its fee earners.PwC itself has already confirmed that its 300-strong Lehman team is generating weekly fees of £4m. Legal counsel typically generate between a third and half of the fees of administrators, suggesting a fee level for Linklaters of more than £1.25m a week.In addition, partners at another law firm involved with Lehman's administration have indicated the complexity of the mandate means that Link-laters' fees have approached the $800,000 (£533,000) to $1m (£666,000) mark on busy days. The level of fees means that Lehman is almost certain to surpass the size of previous big ticket UK insolvency mandates such as the restructuring of British Energy, which generated more than £25m in fees for Clifford Chance by the time it completed in 2005.The Linklaters team, which is thought to include more than 20 partners, is being led by restructuring chief Tony Bugg and banking partners Richard Holden and David Ereira. The magic circle firm has confirmed that its role advising UK administrator PricewaterhouseCoopers (PwC) is currently engaging "several hundred" of its fee earners.
