Perkins Coie attorney Marc Elias and five other firm attorneys, represented by Kirkland & Ellis partner Paul Clement, are asking the U.S. Court of Appeals for the Fifth Circuit to reconsider the sanctions it levied against the firm’s attorneys for violating ethical rules in a voting case, Texas Alliance for Retired Americans v. Hughs.

On March 12, the Fifth Circuit sanctioned Elias and his team for violating their duty of candor to the court when they filed a motion to supplement the record in February similar to one they filed in September that had been denied by a motions panel. The Perkins Coie attorneys did not note the earlier denial.
