VACATED and REMANDED

OPINION

Before the Court is the parties’ October 9, 2001 “joint motion for: (1) dismissal of restricted appeal, (2) reversal of default judgment, and (3) remand to trial court for entry of judgment in accordance with settlement agreement.” The parties state they have reached a compromise and settlement of all claims and disputes that exist between them. The parties request that this Court dismiss the appeal with prejudice, reverse the default judgment from which the appeal was taken, and remand this matter to the trial court to enter final judgment in accordance with the parties’ mutual release and settlement agreement. The parties’ motion is GRANTED to the extent the November 7, 2000 judgment of the trial court is VACATED, without reference to the merits, and the case is REMANDED to the trial court for further proceedings. See Tex. R. App. P. 42.1 (a)(1).
