A Manhattan judge has rejected a challenge by eight parents of New York City school children to the Department of Education’s ban on the possession of cell phones by students.
In a joint declaratory judgment action and Article 78 proceeding, the petitioners claimed that the city’s decision to ban the possession of cell phones — as opposed to the use of cell phones — lacked a rational basis.
