School districts can be held liable for student-on-student gay bashing and other forms of sexual harassment if teachers know about it and fail to react promptly, the New Jersey Supreme Court has ruled. The court held that a suit brought by a student against the Toms River, N.J., school district was covered by the state Law Against Discrimination and the leading case on hostile work environment sexual harassment. The school board had argued unsuccessfully that the correct standard was the one in Title IX.
