Anti-smoking advocates are again seeking to have the FDA regulate tobacco products, seven years after the Supreme Court ruled 5-4 that Congress had not authorized such regulation. A new bill being offered by a bipartisan group of lawmakers is similar to one introduced last session, but supporters believe it will fare better in the Democratic-controlled Congress. The bill would let the FDA monitor tobacco ads, strengthen warning labels and order the elimination or reduction of harmful ingredients.

Seven years after being rebuffed by the Supreme Court, anti-smoking advocates are again seeking federal regulation of tobacco, a step they say is needed to deter children from lighting up and to get smokers to quit.
“It would have a huge public-health impact. This is a product that when used as directed is lethal,” said Wendy Selig of the American Cancer Society’s Cancer Action Network.
