The denial of long-term disability benefits for a man with kidney disease will present the New York Court of Appeals with an unsettled question of state insurance law.
The 2nd U.S. Circuit Court of Appeals has certified two questions for decision to the state’s highest court, calling for definitive construction of New York Insurance Law �3234(a)(2).
