Three Massachusetts smokers have filed a federal lawsuit demanding that Philip Morris USA Inc. pay for chest scans to detect early stage lung cancer. The plaintiffs, who seek class status, want the company to pay for scans for Marlboro smokers over 50 who have smoked at least a pack a day for 20 years. A company spokeswoman responded: "Smokers' medical monitoring class actions have been consistently rejected by the overwhelming majority of trial and appellate courts since the first one was filed in 1994."
