Deciding a novel issue in New Jersey, an appeals court has ruled that offers of judgment designed to spur settlements remain on the table until there is a judgment, even if it takes more than one trial to reach the outcome.
The court affirmed the award of $48,884 in counsel fees to a plaintiff in an assault case that was tried three times before the plaintiff won $1 million.
