No whistleblower relief is available in the New York State Court of Claims, Judge Philip J. Patti has reluctantly concluded in embracing a 12-year-old decision. Patti said the state Legislature has not extended the court's jurisdiction since his former colleague, Judge John L. Bell, held the whistleblower statute did not specifically contemplate relief in the Court of Claims. Therefore, Patti said, he had to hold that he lacks subject matter jurisdiction in a whistleblower case before him.

No whistleblower relief is available in the Court of Claims, a judge has reluctantly concluded in embracing a 12-year-old trial court decision.
Court of Claims Judge Philip J. Patti of Rochester, N.Y., said the state Legislature has done nothing since his former colleague, Judge John L. Bell, in Taylor v. State, Misc 2d 120, blew the whistle on the whistleblower statute and held that it did not specifically contemplate relief in the Court of Claims.
