A Jones Beach, N.Y., lifeguard has been rebuffed in his effort to set aside the jury verdicts in his defamation lawsuit against two fellow lifeguards whom he accused of making comments that helped deny him a promotion.

Nassau County Supreme Court Justice William R. LaMarca refused to set aside the verdicts in Palumbo v. Peters, 6812/04, saying that the issues of damages and liability had been “fully and fairly litigated.”
