The Equal Employment Opportunity Commission has filed a federal lawsuit against the Sara Lee division in Sioux Falls, S.D., accusing the food company of not promoting three black employees because of race. EEOC attorney Jean Kamp said the suit was filed after the agency tried to reach a voluntary settlement with Sara Lee. Kamp said that one plaintiff who was applying for a foreman job "was told by a midlevel supervisor that under current management, there would never be a black foreman."

Since at least 2003, James Meier, Rickey Johnson and George Clark Jr. applied for foreman positions but were denied the opportunity to move up, according to the civil complaint filed Tuesday in U.S. District Court in Sioux Falls.
