A New York federal judge has ruled that due to the precedent set by the recent U.S. Supreme Court case Garcetti v. Ceballos , former police sergeant Angelo Ruotolo cannot seek damages for a retaliation claim under the First and 14th Amendments. Judge Sidney Stein said the environmental report Ruotolo prepared about hazards at a New York City precinct house "is exactly the type addressed in Garcetti ; i.e., employer commissioned work over which the employer is entitled to exercise control."
