A law requiring the Pennsylvania Turnpike Commission to engage in collective bargaining with its first-level supervisors, or frontline management, has hit a dead end. The state Supreme Court held unanimously that the act, which applied to a single public employer, ran afoul of the state constitutional provision banning special legislation for selected actors. All other state agencies are not required to engage in collective bargaining with frontline management.

The law governing collective bargaining for the Pennsylvania Turnpike Commission’s managerial personnel is unconstitutional special legislation, the state Supreme Court has decided unanimously.
In so holding, the high court rejected the statute’s requirement that the turnpike commission engage in collective bargaining with its first-level supervisors, or frontline management.
